  • If you are ever unsure how to handle a client, it would be wise to seek supervision and guidance from a professional psychotherapist, police officer, social worker, pastor, or mental health staff. You can call 911 and ask the police to do a well check on a client if you're concerned about their mental health. You can also require students and clients with mental health concerns to obtain permission from their provider to work with you.

Hereby, the course shall be referred to as School or Course interchangeably to mean COURSE:

1. Terms

By accessing this course, you are agreeing to be bound by these Terms of Use, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this Course are protected by applicable copyright and trademark law. Students may not replicate any part of the course as it is the intellectual property of Dr. Amanda Brees. Certification is NOT included in the course; only the option to fulfill all graduation requirements to apply to certify. Failure to finish the payment plan does not recuse the student from owing the balance due on the account for the rest of the purchase agreement amount barring emergencies.

Non-Disparagement. Students shall not, at any time during the Term and thereafter, make statements or representations, or otherwise communicate, directly or indirectly, in writing, orally, or otherwise, or take any action which may, directly or indirectly, disparage the Bank or the Company or any of its subsidiaries or affiliates or their respective officers, directors, employees, advisors, businesses or reputations. Notwithstanding the foregoing, nothing in this Agreement shall preclude students from making truthful statements that are required by applicable law, regulation or legal process.

The parties agree to enter into a confidential relationship with respect to the disclosure of certain proprietary and confidential information ("Confidential Information").

1. Definition of Confidential Information. For purposes of this Agreement, "Confidential Information" shall include all information or material that has or could have commercial value or other utility in the business in which Disclosing Party is engaged. If Confidential Information is in written form, the Disclosing Party shall label or stamp the materials with the word "Confidential" or some similar warning. If Confidential Information is transmitted orally, the Disclosing Party shall promptly provide a writing indicating that such oral communication constituted Confidential Information. This also includes prohibiting the use of confidential and proprietary class information in the course with the court system, general public, or media without written consent.

2. Exclusions from Confidential Information. Receiving Party's obligations under this Agreement do not extend to information that is: (a) publicly known at the time of disclosure or subsequently becomes publicly known through no fault of the Receiving Party; (b) discovered or created by the Receiving Party before disclosure by Disclosing Party; (c) learned by the Receiving Party through legitimate means other than from the Disclosing Party or Disclosing Party's representatives; or (d) is disclosed by Receiving Party with Disclosing Party's prior written approval.

3. Obligations of Receiving Party. Receiving Party shall hold and maintain the Confidential Information in strictest confidence for the sole and exclusive benefit of the Disclosing Party. Receiving Party shall carefully restrict access to Confidential Information to employees, contractors, and third parties as is reasonably required and shall require those persons to sign nondisclosure restrictions at least as protective as those in this Agreement. Receiving Party shall not, without prior written approval of Disclosing Party, use for Receiving Party's own benefit, publish, copy, or otherwise disclose to others, or permit the use by others for their benefit or to the detriment of Disclosing Party, any Confidential Information. Receiving Party shall return to Disclosing Party any and all records, notes, and other written, printed, or tangible materials in its possession pertaining to Confidential Information immediately if Disclosing Party requests it in writing.

4. Time Periods. The nondisclosure provisions of this Agreement shall survive the termination of this Agreement and Receiving Party's duty to hold Confidential Information in confidence shall remain in effect until the Confidential Information no longer qualifies as a trade secret or until Disclosing Party sends Receiving Party written notice releasing Receiving Party from this Agreement, whichever occurs first.

5. Relationships. Nothing contained in this Agreement shall be deemed to constitute either party a partner, joint venturer or employee of the other party for any purpose.

6. Severability. If a court finds any provision of this Agreement invalid or unenforceable, the remainder of this Agreement shall be interpreted so as best to effect the intent of the parties.

7. Integration. This Agreement expresses the complete understanding of the parties with respect to the subject matter and supersedes all prior proposals, agreements, representations, and understandings. This Agreement may not be amended except in a writing signed by both parties.

8. Waiver. The failure to exercise any right provided in this Agreement shall not be a waiver of prior or subsequent rights.

2. Use License

1. Permission is granted to temporarily download one copy of any downloadable materials on the course's website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license, you may not:

modify or copy the materials;

use the materials for any commercial purpose, or for any public display (commercial or non-commercial);

attempt to decompile or reverse engineer any software contained on the School’s web site;

remove any copyright or other proprietary notations from the materials; or

transfer the materials to another person or 'mirror' the materials on any other server.

2. This license shall automatically terminate if you violate any of these restrictions and may be terminated by Company at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.

3. Disclaimer

The materials on the course's website are provided 'as is'. The course makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, the course does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.

4. Limitations

In no event shall the course be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on the course's website, even if the course or an authorized of the course has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

The course has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by the course of the site. Use of any such linked website is at the user's own risk.


7. Site Terms of Use Modifications

The course may revise these Terms of Use for its website at any time without notice. By using this website you are agreeing to be bound by the then current version of these Terms of Use.


8. Governing Law

Any claim relating to the course website shall be governed by the laws of the course's Owner’s home jurisdiction without regard to its conflict of law provisions.


9. Disclaimer

The Client understands the Company is not an agent, publicist, accountant, financial planner, lawyer, therapist, or any other licensed or registered professional. Coaching, which is not directive advice, counseling, or therapy, may address overall goals, specific projects, or general conditions in the Client’s life or profession. Coaching services may include setting priorities, establishing goals, identifying resources, brainstorming, creating action plans, strategizing, asking clarifying questions, and providing models, examples, and in-the-moment skills training. The Company promises that all information provided by the Client will be kept strictly confidential, as permissible by law.


10. NON-DISCLOSURE OF COMPANY MATERIALS

Material given to the Client in the course of the Client’s work with the Company is proprietary, copyrighted, and developed specifically for the Company. the Client agrees that such proprietary material is solely for the Client’s own personal use. Any disclosure to a third party is strictly prohibited. The Company’s program is copyrighted and the original materials that have been provided to the Client are for Client’s individual use only and are granted as a single-user license. The Client is not authorized to use any of the Company’s intellectual property for Client’s business purposes. All intellectual property, including Company’s copyrighted program and/or course materials, shall remain the sole property of the Company. No license to sell or distribute Company’s materials is granted or implied. Further, by signing below, Client agrees that if Client violates, or displays any likelihood of violating, any of Client’s agreements contained in this paragraph, Company will be entitled to injunctive relief to prohibit any such violations and to protect against the harm of such violations.


11. NON-DISPARAGEMENT

Client shall not make any false, disparaging, or derogatory statement in public or private regarding Company, its employees, or agents. Company shall not make any false, disparaging, or derogatory statements in public or private regarding Client and its relationship with Company.


12. INDEMNIFICATION

Client agrees to indemnify and hold harmless Company, its affiliates, and its respective officers, directors, agents, employees, and other independent contractors from any and all claims, demands, losses, causes of action, damage, lawsuits, judgments, including attorneys’ fees and costs, arising out of or relating to, Client’s participation or action(s) under this Agreement. Client agrees to defend against any and all claims, demands, causes of action, lawsuits, and/or judgments arising out of, or relating to, the Client’s participation under this Agreement, unless expressly stated otherwise by Company, in writing.


14. DISPUTE RESOLUTION

The parties agree to first attempt to resolve differences by good-faith negotiation.


15. ENTIRE AGREEMENT; AMENDMENT; HEADINGS

This Agreement constitutes the entire agreement between the Parties with respect to its relationship and supersedes all prior oral or written agreements, understandings and representations to the extent that they relate in any way to the subject matter hereof. Neither course of performance, nor course of dealing, nor usage of trade, shall be used to qualify, explain, supplement or otherwise modify any of the provisions of this Agreement. No amendment of, or any consent with respect to, any provision of this Agreement shall bind either party unless set forth in a writing, specifying such waiver, consent, or amendment, signed by both parties. The headings of Sections in this Agreement are provided for convenience only and shall not affect its construction or interpretation.


16. ACCEPTANCE

This Agreement is deemed signed and accepted by Client and Client’s electronic signature to accept the terms of this Agreement and Client’s purchase of the Program.


17. SEVERABILITY

Should any provision of this Agreement be or become invalid, illegal, or unenforceable under applicable law, the other provisions of this Agreement shall not be affected and shall remain in full force and effect.


18. WAIVER

The waiver or failure of the Company to exercise in any respect any right provided for herein shall not be deemed a waiver of any further right hereunder.


19. ASSIGNMENT

This Agreement may not be assigned by either party without the express written consent of the other Party.


20. FORCE MAJEURE

In the event that any cause beyond the reasonable control of either Party, including without limitation acts of God, war, curtailment or interruption of transportation facilities, threats or acts of terrorism, State Department travel advisory, labor strike, or civil disturbance, make it inadvisable, illegal, or impossible, either because of unreasonable increased costs or risk of injury, for either Party to perform its obligations under this Agreement, the Affected Party’s performance shall be extended without liability for the period of delay or inability to perform due to such occurrence.

THE STATE OF MINNESOTA HAS NOT ADOPTED ANY EDUCATIONAL AND TRAINING STANDARDS FOR UNLICENSED COMPLEMENTARY AND ALTERNATIVE HEALTH CARE PRACTITIONERS. THIS STATEMENT OF CREDENTIALS IS FOR INFORMATION PURPOSES ONLY.

Under Minnesota law, an unlicensed complementary and alternative health care practitioner may not provide a medical diagnosis or recommend discontinuance of medically prescribed treatments. If a client desires a diagnosis from a licensed physician, chiropractor, or acupuncture practitioner, or services from a physician, chiropractor, nurse, osteopathic physician, physical therapist, dietitian, nutritionist, acupuncture practitioner, athletic trainer, or any other type of health care provider, the client may seek such services at any time.

INSURANCE/FINANCES: The client has a right to reasonable notice of changes in services or charges. Yoga therapy is sometimes covered under HSA spending accounts with certain indications, but you are responsible for any portion insurance doesn't cover. Please note that I do not provide primarily physical (postural) yoga. The work I do is focused on complex PTSD, relational trauma, and family healing through meditation, pastoral counseling, and touch. Otherwise, services are $75/hr payable at the end of each session. Please provide a 24-hour cancellation notice for non-emergencies. Satisfaction guaranteed or money back. Payment plans and inclusivity scholarships are available if the cost is prohibitive. I am insured through Farm Bureau and the National Association of Complementary and Alternative Medicine.

THEORETICAL APPROACH: Yoga therapy is not a licensed healthcare practice. Furthermore, massage therapy is not licensed in Winona County (it is licensed within the city limits of Winona). Finally, pastoral counseling is not a licensed healthcare practice. Herbalism and reiki are not licensed healthcare practices. These services are rendered by an ordained minister who teaches/implements complementary spiritual therapies to support, nurture, and calm the nervous system and heart. Alternative medicine is a well-studied field of healing that uses non-clinical interventions for spiritual healing. I have conducted a peer-reviewed research study that resulted in substantiating a theory that complementary therapies are effective in healing family trauma. I am an ordained minister offering pastoral counseling and alternative medicine services in alignment with my grounded research theory.

CLIENT RIGHTS: You, the client, have a right to complete and current information concerning the practitioner's assessment and recommended service that is to be provided, including the expected duration of the service to be provided. You may expect courteous treatment and to be free from verbal, physical, or sexual abuse by the practitioner. Your client records and transactions with the practitioner are confidential, unless the release of these records is authorized in writing by the client, or otherwise provided by law. You have the right to be allowed access to records and written information from records in accordance with sections 144.291 to 144.298. Other services may be available in the community through your local church, yoga studio, or massage therapy offices. You have the right to choose freely among available practitioners and to change practitioners after services have begun, within the limits of health insurance, medical assistance, or other health programs. You have the right to coordinate transfer when there will be a change in the provider of services. You may refuse services or treatment unless otherwise provided by law. You may assert your rights without retaliation. Per MN 2020 State Statute 146A.11, clients must sign a copy of this release prior to receiving services. All online/remote ZOOM and phone services rendered shall fall under the legal jurisdiction and laws of the State of Minnesota, Wabasha County, MN. Massage therapy is an unlicensed practice in Wabasha County.

AUTHORIZATION TO RELEASE INFORMATION: As a courtesy to you, I can work as a member of an integrated care team and offer appropriate referrals when necessary. You would be responsible for communicating with these providers and obtaining proper authorizations of release information for us to speak with one another about your care. Be advised that I may offer referrals to other professionals (legal, mental health, social services, acupuncture, etc) as I see fit.

INFORMED CONSENT: Although I have a doctorate (EDD) I am not a medical doctor (MD). Please note, I have completed a CMT program. I sell homemade herbal products as a cottage food producer but do not prescribe psychiatric medications. My priority is your spiritual (as opposed to mental or emotional) health. I am not a licensed mental health provider, and you should consult a licensed marriage and family therapist or family law attorney for the management of trauma and family issues. You should not start or stop any medication without consulting a licensed physician. My products are not intended to cure, treat, or prevent any disease.

MANDATED REPORTING: I am a mandated reporter and am obligated to report your intentions to harm yourself, a child, or someone else.

I also agree to stay bound to the current version of the website and Teachable terms and conditions if I am a website client or student without notice of new revisions to the terms.

Certification

Anyone is welcome to take the course, but only those who complete all graduation requirements will qualify for certification. Anyone on the Personal Pathway can apply for a certificate of completion IF they pass the quiz with a B or better and ask for one.


Those on the Professional Pathway will be certified IF they agree to our guidelines AND send me an email asking to process their certification and graduation after they've completed all requirements.


This course does not issue any accreditation or continuing education credits outside of the International Center for Reiki Training. It is NOT WASC accredited. There are no refunds due to the nature of content delivery. If you are unsatisfied, please email info@yogaofrelationship.co explaining what exactly was unhelpful and I will work with you on a case-by-case basis to resolve your complaints.


Purchase of the course material itself does NOT guarantee certification. Certification is by application for graduates who:

  • Agree to our community standards around conservative Christian religious beliefs, ethics, and moral standards.

Code of Conduct

Students must agree to conduct themselves respectfully in all areas of the course not limited to coaching sessions, written discussion forums, and comment threads.

Students may not threaten, harm or shame fellow participants or the instructor. Displays of racial discrimination will not be tolerated. Students will be issued three written warnings for violations of this code of conduct policy.

Failure to correct the behaviors after three warnings will result in a dismissal from the program without further notice and no refund. Students who have been dismissed from the course for misconduct are ineligible for refunds and still liable for the remainder of their payment plan for the materials.

In special circumstances, the student and teacher can agree to drop the payment plan balance due or issue a partial refund if the teacher and student agree that the content is not a good fit, but the student has not violated the terms of use of the course. These agreements will be at the full discretion of the professor of the course (Dr. Brees) without intervention in a court of law.

Failure to complete the course, failure to understand the materials, and disagreement with the professor about what is being taught are ineligible reasons for refunds.

If disagreement persists, the parties agree to use natural mediation service to resolve their differences through arbitration instead of court processes to the extent the law allows it.
